1. Bharatiya Nyaya Sanhita (BNS) :- Key Changes

  1. Sedition Law Repealed: 'Sedition' means Rajdroh is completely repealed and Replaced by with acts endangering 'Sovereignty' or 'Treason' (Section - 152) দেশের সার্বভৌমত্ব ও অখন্ডতার বিরুদ্ধে অপরাধ দেশদ্রোহ নামে নতুন ধারা আনা হয়েছে (ধারা ১৫২)
  2. Mob lynching: (গণপিটুনি) প্রথম বার মব লিঞ্চিং বা গণপিটুনিকে আলাদা অপরাধ হিসাবে যুক্ত করে যাবজ্জীবন কারাদণ্ড বা মৃত্যুদণ্ডের বিধান রাখা হয়েছে।
  3. Hit and Run Law: গাড়ি দুর্ঘটনায় কারও মৃত্যু হলে চালক যদি পুলিশকে না জানিয়ে পালিয়ে যায় তবে ১০ বছরের জেল ও জরিমানার নিয়ম করা হয়েছে।
  4. Community Service: (সমাজসেবা) ছোটো খাটো অপরাধের ক্ষেত্রে প্রথম বারের জন্য সমাজসেবা বা Community Service কে আইনি শাস্তি হিসাবে স্বীকৃতি দেওয়া হয়েছে।
  5. Terrorism and organized crime: প্রথমবারের মতন সুনির্দিষ্টভাবে সন্ত্রাসবাদ ও সংগঠিত অপরাধের সংজ্ঞা দেওয়া হয়েছে।

Major changes in IPC Sections:

  • Murder (খুন): Old IPC 302 → New BNS 103
  • Cheating/Fraud: Old IPC 420 → New BNS 318
  • Rape: Old IPC 376 → New BNS 63

2. Bharatiya Nagarik Suraksha Sanhita (BNSS) - Key changes:

  1. Zero FIR: An FIR can be filed at any Police station across the country regardless of where the crime occurred.
  2. e-FIR: Citizens can file FIRs online or electronically, but must sign it physically within 3 days.
  3. Mandatory Forensic Evidence: Forensic team visits and videography of the crime scene are mandatory for offenses punishable by 7 years or more.
  4. Speedy Trial and Judgment: Judges must deliver the judgment within 45 days after the trial (arguments) concludes.

3. Bharatiya Sakshya Adhiniyam (BSA) - Key changes:

  1. Electronic/Digital Evidence: Digital records (emails, server logs, smartphones, location data) are given the exact same legal validity as traditional paper documents.
  2. Witness Protection and Virtual Testimony: Formalizes rules to protect witnesses and allows testimonies/trials to be conducted via video conferencing.
